These Terms and Conditions govern your use of Engineering Rapid Tools.

Engineering Rapid Tools is a Cloud Computing Service based in Europe and powered by a team of civil engineers. It is sponsored and operated by Thexa Innovation Limited.

The following terminology applies to these Terms and Conditions, Privacy Policy all Agreements: "Client", "User", "You" and "Your" refers to you, the person log on this website and compliant to the Company’s terms and conditions. "Engineering Rapid Tools", "ERT", "Web Application", "Cloud Service", "Service", "Ourselves", "We", "Our" and "Us", "Author", "Company", refers to Thexa Innovation Limited, a private company limited by shares registered in Hong Kong under company number 3213650 whose registered office is Unit 1603, 16th Floor, The L. Plaza, 367 - 375 Queen's Road Central, Sheung Wan, Hong Kong. "Tool" refers to any calculation tool made available by Engineering Rapid Tools and accessible through this web site. "Party", "Parties", or "Us", refers to both the Client and Ourselves. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.

End User Agreement

By accessing accessing this website, purchasing and using any Tool available on this website you understand and agree to the following Terms and Conditions. If you do not agree with Agreements or you cannot comply with Agreements, then you must not use Engineering Rapid Tools service.

Service usage Terms and Conditions

The Tools available on this web page carry out numerical analysis that can be applied, but not limited, to structural analysis and design. Access to these Tools is not limited and can also be anonymous. However, analysis and results must be double-checked by the user, especially when applied to real structures. As an ERT user, it is your responsibility to verify and validate the software output by other independent means.
As a user of Engineering Rapid Tools, you understand and agree to use a software that can include errors in theoretical models, wrong interpretation of the standard specifications, errors in translating theoretical models into numerical algorithms, and may have bugs that cause the Tools to function incorrectly, generating wrong and unexpected results. As a user of ERT, you understand that although all Tools goes through testing and validations, the risk of wrong results due to software error is still possible.
The Tools available on ERT do not replace any work or advice given by a professional engineer. Results must not be used for design purposes unless validated and signed by a competent professional engineer.
Tools published in this web are provided "as is", whitout warranty of any kind, express or implied. In no event shall the author be liable for any claim, direct or indirect damages arising from using this software.

Payment and use of the service

You can freely access and use the Tools, even anonymously, and you are free to copy the tables and reports from this website and paste into your report, without paying. The Tools you are using for free may have some hidden results. Also, you will not be able to download any reports or drawings for the Tools you are using for free.
You can purchase the service that allows you to view full analysis results and allow you to generate an unlimited number of analyzes, reports and drawings. The acquired service is valid for a single Tool and has a duration of 24 hours starting from the moment in which the payment is successful.
If you wish to use the Tool in different sessions, you must download the Tool you paid for and save it on your device. To use it within 24 hours of validity, you must upload in Our web application the same Tool previously saved on your device.
You may not rent, lease, transfer the right to use the Tool to another person or legal entity without the prior written consent of ERT.
We may employ the use of third party services for the purpose of facilitating payment and the completion of Purchases. By submitting your information, you grant us the right to provide the information to these third parties subject to our Privacy Policy.

Refund

The service is sold as a final since you have had the opportunity to perform the analysis, so there is no refunds unless under exceptional circumstances, such as you encounter a real defect.

Please, agree to pay only after the analysis is performed and you are comfortable with the results.

Account

When you create an account with us, you guarantee that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on Engineering Rapid Tools.

You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with our Service or a third-party service. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Your personal account with us gives you the possibility to save your tools on our server. You must always save a copy on your device because, even if we do our best to maintain the servers, unexpected technical problems may occur that lead to the cancellation or alteration of all your data saved on our server. ERT is not responsible for the loss of your data saved on our server. You can save only a limited number of tools on our server, because the space available on our hard disk is limited.

License

The Calculation Tools and materials available in this website (excluding Content provided by users) are all the intellectual property of Engineering Rapid Tools and its licensors.

You are allowed to duplicate and republish the material downloadable from this website (such as validation documents, examples, images), even partially, conditionally on crediting Enginnering Rapid Tools as Author and inclusion of the link to www.rapidtools-eng.com. You are not allowed to modify any material downloadable from this website without the written authority given by the Author.

This Service is protected by copyright and other laws of foreign countries. You may access this website for your own personal use subjected to restrictions set in these terms and conditions.

Changes To Service

We reserve the right to withdraw or amend our Service, and any service or material we provide via Engineering Rapid Tools, in our sole discretion without notice. We will not be liable if for any reason all or any part of Service is unavailable at any time or for any period. From time to time, we may restrict access to some parts of Service, or the entire Service, to users, including registered users.

We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion.

Your preferred language and system of measurement are collected every time you access our site and you set them, even if you do so anonymously, and we use them to improve your experience. If you have an account registered with us, we will include preferred language and system of measurement in your account properties.

Your IP address is collected every time you access this site, even if you do so anonymously. We use your IP address to determine the country you are connecting from. We use this information to keep the history of our consumers' interactions with our website which will help us to better develop our service. We do not make any connection between your account and your IP address

Engineering Rapid Tools shall not distribute, share or release any personal information to any third party unless that use is for internal use by ERT.

Engineering Rapid Tools will never share file data stored by you in our server.

Engineering Rapid Tools will never sell your personal data.

Payment informations

We use third-party services for payment processing.

We will not store your payment card details. That information is provided directly to our third-party payment processors whose use of your personal information is governed by their Privacy Policy. These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of payment information.

When you buy a service in our Web Application, we collect and store in our server the following data:

Email address
Name and surname
Payment receipt

We create a Service Account that includes your email, your name and surname and the reference code that enables you to use the purchased service. We will delete the Service Account from our server at the latest 7 days after the expiry of the purchased tool. We will not connect the Service Account with your personal account registered in our Web Application.

We keep the payment receipt, the same one you receive when you make the purchase, in a place accessible only by the administration of Thexa Innovation Limited, for accounting and auditing purposes.

Tracking Cookies Data

We use cookies and similar tracking technologies to track the activity on our Service and we hold certain information. Cookies are files with a small amount of data which may include an anonymous unique identifier. Cookies are sent to your browser from a website and stored on your device.

If you do not accept cookies, you may not be able to use some portions of our Service.

The security of your data is important to us but remember that no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security.

Please note, if you ask us to remove the Service Account, you can still continue to use a paid tool until it expires but we may not be able to assist you, and, in case you lose the file containing the payment tracking reference code, you will no longer be able to get a copy and your paid service will no longer be accessible.
